Such an agreement may be incorporated in a contract between the parties out of which the disputes and differences have arisen, or by a separate agreement, which the parties may enter into. The arbitration agreement which would enable the Centre to administer the arbitration should follow the pattern of these model arbitration clauses:

• This model clause is to be incorporated in a contract:
"Any dispute, controversy or claim arising out of or relating to this contract, or the breach, termination or invalidity thereof, shall be decided by arbitration in accordance with the Rules for Arbitration of the Kuala Lumpur Regional Centre for Arbitration."

NOTE: Parties may wish to consider adding: (a) The appointing authority shall be the Kuala Lumpur Regional Centre for Arbitration. (b) The number of arbitrators shall be ....... (one or three). (c) The place of arbitration shall be .......... (town or country). (d) The language(s) to be used in the arbitration proceedings shall be ......... (e) The law applicable to this contract shall be that of ......... 

• Parties wishing to substitute an existing arbitration clause for one referring the dispute to arbitration under the Rules of the Kuala Lumpur Regional Centre for Arbitration may adopt the following form of agreement. This form may also be used where a contract does not contain an arbitration clause:

"The parties hereby agree that the dispute arising out of the contract dated __________ shall be settled by arbitration under the Rules of the Kuala Lumpur Regional Centre for Arbitration."
